Ilan Elhayani, Criminal Defence lawyer

Specialising in International Law Criminal Litigation & Custody

You seek an expert

Over the last 20 years we have handled all manner of criminal charges in various Criminal Courts in Israel and abroad, from the least to the most serious.  Being former prosecutors at the district attorney service coupled with more than 20 years of accumulative experience allow us to walk into courtrooms with confidence.

Our familiarity translates for our clients into a better experience in court.

Deep familiarity means for our clients a higher level of predictability. Never it is more than that. We know each case is always decided based on its facts according to the law.

Although every lawyer can take your case, it is essential for you to hire an expert very much the same way that you will seek an expert advice in case of medical need.

The nature of the criminal profession is that it is moving rapidly towards a subject-based expertise where some lawyers tend to focus their legal work on drugs, or juvenile related cases.

When we walk into courtrooms, we do it with full confidence. The police officer that moments before seemed to you as all mighty, will certainly be subjected to harsh questions and professional dilemmas. We probably can tell and pick up things that many other lawyers who are not practicing criminal law will fail to identify. In Jerusalem district many judges are familiar with us.  We can share with our clients sometimes our experience with a particular judge attitude in the past. Some of them we have appeared before since the day we started.  Many of the prosecutors are familiar with our calm yet aggressive approach in defending our clients.

Familiarity

Predictability

Our familiarity translates for our clients into a better predictability.

Any given client subjected to the ordeal of facing criminal proceedings is puzzled with many questions and dilemma.  Once you are diligent and disciplined client, it will certainly can assist us to portray you the most possible paths for your case with a clear roadmap and milestones as to what will be reasonable to expect. Never it is more than that. We cannot of course guarantee results. We can guarantee you the outcome of serious mistakes you can do along the way. Some of which will be impossible to rectify at a later stage.

Hiring the wrong lawyer, or following inadequate legal advice is and can be a serious mistake. The reality is that in many cases the appellate courts decisions should bring one to the conclusion that you are better off without a lawyer at all rather than being represented by a lawyer that gave you wrong advice.

Public Defense

We know that in many cases our clients are eligible for their case to be handled by the public defence office.

We don't work for the public defense service.

We do appreciate the supreme goal of the public defense system to provide high quality and professional legal representation. It is our joined effort to promote the best interests and protect the rights of our suspects, defendants and convicts.

No Guarantees

A criminal lawyer is not allowed to set his fees subjected to a specified results of the proceedings. Not only that he will be found committing an offense under section 84 (a) of the Bar Association Act, 1961 it will certainly be irresponsible to guarantee results.

The criminal proceeding surrounds a large number of variables, which can never be under the complete control of the lawyer. A judge may reach a certain result in the face of the evidence presented to him, while another judge may, based on the exact same evidence, reach the opposite result.

No Solicitation

Unfortunately, some criminal lawyers (whether by phone or in courtrooms) approach potential clients and offering them their services with tempting offers at a ridiculously low fees rates.

You are more than advised to politely reject any attempted solicitation: Beyond the fact that this is an ethical offense conducted by the lawyer (according to section 56 of the Bar Association Act 1961), the solicitation indicates very clear red flag.

Hiring the services of a criminal lawyer should be done seriously, and it is advisable to consult and get recommendations from people close to the field.
